Indian Faces 11 Yrs Jail For ‘Brazen’ Sexual Assault on US Flight

Federal prosecutors in Detroit are seeking 130 months imprisonment for an Indian national, who is in US on H-1B visa, for committing one of the "most brazen airplane sexual assaults".

Prabhu Ramamoorthy, who was arrested following the alleged incident in flight from Las Vegas to Detroit in January, is slated to be produced before a Detroit court on Thursday, 13 December. A federal jury has already convicted him of sexual assault.

HERE’S WHAT HAPPENED

While seated next to his wife, Ramamoorthy allegedly took advantage of a 22-year-old woman traveling alone, federal prosecutors said in a sentencing memo ahead of his appearance before the court.

"As she slept on a late-night flight, he untied her shirt, unzipped her pants, and shoved his fingers inside of her with such force that it woke her up," the prosecutors said.

"It was only then that he stopped, turned the other way, and pretended to sleep on his wife. When confronted by law enforcement, he claimed that he had been in a deep sleep and insisted that he did not intentionally touch her," they said.

Hours later, after relaying multiple different versions of the event, he finally admitted to touching her intentionally.

WHAT RAMAMOORTHY ALLEGED

"Then at trial, he violated her even further by accusing her of imagining the whole thing. He refused to take responsibility for his actions and instead deflected blame onto her," the federal prosecutors said.

Ramamoorthy is from Tamil Nadu. Son of a farmer, he came to the US in July 2015 after his graduation to work as an IT professional.

RAMAMOORTHY’S DEFENCE

During his trial, he presented himself before the court as a confused man stranded in America without English language skills despite his sophisticated technological job, the prosecutors said.

"His lack of empathy and remorse should not go unnoticed by this court," they argued, seeking nearly 11 years of imprisonment for him.

The prosecutor urged the court that Ramamoorthy should not be deported to India before completing his jail sentence.

"Individuals who come to America and commit sexual assaults should not simply be permitted to return to their home countries without fair punishment," the federal prosecutors said.

Ramamoorthy's lawyers urged the court for a minimum incarceration period, arguing that he has no criminal history and led a normal crime-free life.

His life is "effectively over", Ramamoorthy's lawyer told the court, adding, "As a result of this case, he will have been incarcerated, assaulted in custody, and eventually will be released to a life of shaming and great difficulties".

WHAT THE STATS TELL US

In recent years, a number of Indian nationals have been arrested or charged with sexual assaults inside a plane. The FBI says airplane sexual assault is a serious offense that is on the rise. FBI statistics indicate that investigations of mid-air sexual assaults increased by 66 percent from 2014 to 2017.

That is in part due to increasingly "cramped, confined spaces; alcohol and drugs; fewer flight attendants; and dark cabins on night flights" - factors that "likely embolden offenders", the FBI said in a recent report.

The cramped style of airplane seating can exacerbate trauma for victims.

According to mental health professionals, victims who are violated in confined spaces feel even more helpless, vulnerable, and powerless.

Victims may also feel intimidated by the person sitting next to them since the seating arrangement means that the perpetrator is effectively blocking the victim from getting up, according to the FBI.

I don't think they should jail him there. Their standards are pretty decent. Get him extradited and throw him into an indian jail for 10 years.
 
Hell with such indian spoiling indian name overseas.
This forces to rethink on new laws specifically for indians and we will be seen from a different angle as criminals.
He should be stripped from working anywhere and be jailed for 15yrs.

Of course compared to Indian standards, its at least something. Recently, a guy who harassed and destroyed a girls life by posting her morphed nude photos and phone number online advertising her as a call girl was made to pay a penalty of Rs 250 as punishment in a court. The court might as well have given him the option of a subscription plan for doing even more offenses. Indian society and the legal system actively encourages this sort of brazen behavior which is why you so often see Indians indulging in everything from groping on flights to rapes.

Some time back, there was another example of a NRI who raped a white american who was staying in the same hotel while in India and tried to justify it by saying that he thought that white women liked doing it with strangers all the time and hence ignored it even though she was resisted.

See, this is the problem right there. Utter nonsense. Rules that empower women to such an extent only get used as blackmail to extort by those so inclined. How far is it to the death penalty for rape then ? keep in mind death penalty for rape is a death sentence on the victim so legislators will never pass such rules.

Where is the principle of proportionality ? Punishment should match the crime.

In this case punishment evidently far exceeds the crime. 11 years for what has been described above is ridiculous. It should be much shorter. The case will go to appeal and then we will see what the quantum will be. If defendant has the funds to fight the case.

For comparison, punching some one and breaking their nose gets you two years. I was witness in a UK court to such an assault. Even that amazed me. Boys will be boys i thought.

I've read of cases in the US & UK where speaking on the phone while driving a car, getting distracted and slamming into a parked car and killing the person inside got 5 years tops. Involuntary manslaughter they call it.

Kill some one and get out in 5 years.

Bullshit! why only Indian name gets spoiled. When a local does it what does it mean.

There are westerners who come to the country and neighbouring ones that are declared as pedophiles in their home countries yet they come here and get away with what they want. Are they spoiling name of their country ?

There had been many incidents where white women get scared of fellow non-white passengers. And this story happened during the "Indians are rapist" period after the Delhi incident. So, there is a good possibility this guy in innocent, and him being Indian was the reason for his downfall.

I feel zero shame about this incident as a male or an indian. Why should I. I'm not responsible for what other men do. The same applies with rapes.

I've had arguments with friends abroad who think rape is part of Indian culture as if rape never gets committed by their people.

Thank you! Atleast some people here have an idea of self respect. Why would I feel bad because some random asshole decided to touch other woman on a flight? what do I share with him apart from race/ color of skin? If people decide to stereotype according to color of skin, then its their problem. I wouldn't waste time thinking about them

Indian men have a history of such misadventures on board fights. It is more than just a one off incident and that image got created for a reason. There is no smoke without fire. Excessive flirting, groping, drunken fits etc. Many of these Indian men apparently seem to view foreign women as having loose morality and try their luck. It is a justification used often.

This was a big problem even when private airline industry picked up in India with female crew being made target of harassment and misbehavior.

And no, the general image about Indian men being linked to harassment and rapes has nothing to do with the Nirbhaya rape incident either. That incident only reinforced the fact that there will be nothing much done to discourage and punish it in this country. Even back in 2004, when I started working, american women traveling to India and particularly to Delhi got travel advisories about molestation and rape in the country. Even back then, there were numerous incidents of foreign women being threatened and raped and dumped on the way from airport by taxi drivers. This is one of the prime reasons that even back in those days, there was a system of airport police noting down passenger details along with the prepaid cab details. Much of the incidents were suppressed from main stream media to protect the "image" of the country, but these happened on a regular basis, foreign women being raped by taxi drivers, in hotels and in the places where they stayed. There was one horrible case where a foreign tourist was gang raped by some people and when she approached the police, she was gang raped twice by the police.

Even the track record of child rape within the country is crazy. Just the reported cases are over 36000 per year and growing. That's nearly 100 child rapes per day and the the official report rate is likely less than 1% just like with normal rape in general. Raping or molesting children and babies as young as 3-6 months is not a common crime in other countries and even when they do happen, they are not taken so trivially as in India. So yeah, I cannot blame them for treating all Indian men with suspicion.

What you're saying is quite the opposite, If anything India is an easy target for foreign media to portray as a rape/pervert capital.
There are plenty of even worse incidents that happen abroad that are under-reported and covered up because they need to keep the charade going that they are morally superior.

European countries have a huge problem with child porn and pedophile rings but you'll never read much about that anywhere, nor will you read anything about instagram models travelling to the middle east to be defecated upon by rich arabs. Just two years back there was a massive scandal where one of the biggest child porn rings was busted in Norway with over 100 TB of child porn shared among lawyers and politicians, don't even get me started on actual cults involving actual satanic ritual abuse in the USA or the free pass priests get to go around sodomizing young boys.
Perverts are everywhere and incidents on flights are not exclusive to Indians but parroting MSM narratives with hidden agendas isn't the solution, even with considering the under-reported cases, India is still better than most democracies statistically (per capita).
 
You have got to be delusional if you believe Indian sexual assault statistics are lower than other countries, especially considering how under-reported they are here.
